What happened to forgotten properties?

As of January 1, 2024, based on the 10-year period stipulated in the Civil Code (§ 1050 para. 2), 16,300 hectares of real estate (120,000 parcels) worth over ten billion CZK were transferred to the state. Most of these properties belonged to long-deceased owners whose assets were overlooked in inheritance proceedings and subsequently forgotten.

Is it still possible to fight for the property?

Yes, there is still a possibility to seek property restitution, even if the state is registered as the owner in the cadastre. Some experts consider the ten-year non-use of ownership rights merely as a presumption of property abandonment that can be refuted in certain cases. Unfortunately, from January 1, 2024, property claims can only be made through a declaratory lawsuit.
